Rick Morse, the owner of a medical-marijuana clinic in the Tower District who was ordered to finish a 15-day sentence in the Fresno County Jail for violating a court order, is free because of jail overcrowding.
Morse was released Monday night along with about 36 other inmates, Jail Commander Rick HIll said today. On Thursday, Judge Donald Franson Jr. sent Morse to jail back to jail for continuing to sell the drug in violation of the order. Morse was initially sentenced to jail May 14, but he spent only eight hours behind bars before being released because of overcrowding. The sheriff's office is at odds with Franson over Morse's incarceration. Franson said Thursday that state law gives him the "inherent power" to keep Morse in jail. The same day, Hill said Sheriff Margaret Mims believes "federal law trumps state law."
