Tennessee Titans backup QB, Chris Simms, was charged in New York on Thursday with driving while impaired by drugs.

The former University of Texas QB was stopped at a downtown Manhattan police checkpoint where police say Simms told them he had been smoking marijuana in the car earlier.

According to police, when stopped Simms slurred his words, had bloodshot eyes, and smelled of marijuana.

Simms’ lawyer, Nathan Semmel, said, “My client never admitted to smoking marijuana that night. He admitted to smoking cigarettes that night.”

Semmel proceeded to call it “absurd” to suggest that Simms would drive impaired while his wife, eight months pregnant with their second child, was riding in the car.

“There’s nothing in his record, whatsoever, that suggests that he would be that reckless,” Semmel said.

Semmel suggested two unidentified passengers in the back seat could have been “the source of the odor” of marijuana that police reported.

Simms refused to plead guilty, pay a $5,000 fine, do three days of community service, and have a six month drivers license revocation. If he is found guilty he could face up to a year in jail and a $1,000 fine.

The Titans released a statement saying they were aware of the case and are in the process of gathering more information about it.
