Default More Information Sought On Medical Marijuana

The Lake County Planning and Zoning Commission is waiting for more regulation information from the state before continuing discussions on local regulations for medical marijuana.

"I don't know what to do with this," said Heather Lindh, planning and zoning commission member, of the information presented at the meeting, which included sample regulations from communities such as Durango, Fremont County, Fruita, Eagle County and Summit County. A letter from Lake County Build a Generation was also included.

Janice Sabers, Lake County Land Use Department, said that Chaffee County has a moratorium and is not yet dealing with the medical marijuana issue.

Already in Lake County are two store-front dispensaries, which are called centers in recently passed Colorado legislation, and two growing operations for those dispensaries.

The state regulations required the centers to grow 70 percent of their own marijuana, making grow operations necessary.

The location of these operations is to remain out of public knowledge, according to the new law.

This was a concern for Lindh, who saw the possibility of other counties buying the product with no benefit to Lake County in taxes.

Dispensary owners Dan Pedrow and Steve Sipes both admitted that they will grow 100 percent of their own, as will most dispensary owners.

"If you are growing 70 percent, why not grow all of it," said Pedrow.

According to Sabers, there could be a conditional process for grow operations that leaves the location unknown, which would also mean not notifying property owners within 500 feet.

Other concerns with growing operations could be mold and fire issues, which means the building and fire departments, at least, should be aware of the operations.

The state may be changing legislation where this is concerned. If this is the case, said Lindh, then the commission should also wait for those changes before making a decision.

Leadville Planning and Zoning Commission is also waiting to make a decision on these regulations. It is waiting for feedback from city council.
