A judge today is set to consider whether to block Anaheim's ban on medical marijuana dispensaries.
A medical-marijuana group, called Qualified Patients Association, is suing the city to challenge the ban, saying it conflicts with state law and violates the civil rights of disabled people. Voters approved a state proposition in 1996 to support marijuana use for medical reasons, but federal law prohibits the drug. Judge David Thompson of Orange County Superior Court has temporarily halted the law, but today will consider whether to continue to block the ban until a trial can be held. Over the summer, the Anaheim City Council approved an ordinance to outlaw dispensaries that issue marijuana to patients. The association opened in the city about five months ago. Fourteen other Orange County cities have banned or are considering bans on such outlets.
