The city of San Jose will be holding an election within the next 2 weeks and like many others, I am receiving a lot of “Vote For Me” stuff in the mail. Anyway, because I know so little about them, I sent each candidate an e-mail which simply said:
“I am with a pro-Medical Marihuana group. Can you please tell me where you stand on the issue? “ The responses that I got back are kind of interesting. In a way, just the questions is forcing the candidates to take the issue of Medical Marihuana seriously. As District Attorney, I would not be able to control the actions of the FBI, DEA, and other federal law enforcement agencies which enforce federal laws which do not recognize an exception for 'medical marijuana.' Like all judicial candidates, I am prohibited from commenting on any legislation or case that might come before me, including medical marijuana. All any judicial candidate can talk about is his or her general judicial philosophy. My judicial philosophy is that the law should dictate the result, and not the reverse. It is not the place of any judge to decide on a result that "feels" right and then find the law to get there. If a majority of the voters, or a majority of the legislature, enact any particular law then it is binding, absent some basic constitutional infirmity. I have attached my candidate's statement, CV and list of endorsements for your review. Cole for Superior Court Judge GSC@george4judge.org Dear Mr. Garrett: Unfortunately, the Judicial Canon of Ethics, requires that I not comment when an issue is one that is, or could come before a court. As this is an issue that is currently before several courts (at different stages of appeal) I am not allowed to reply. The Judicial Council's fear is that a judge may be perceived to exhibit bias, as perception is grounded in the eyes of all possible observers. California does have a specific right to privacy in its Constitution (in Article 1), unlike the Federal constitution. A judge is required to uphold all laws, and as a judicial candidate I have taken an oath to defend and protect the constitutions of California and the United States against all enemies, foreign and domestic. So I am sorry, but I quite literally can not tell you where I myself stand on that issue. I voluntarily surrendered that part of my civil rights when I became a judicial candidate. There is at present a serious legal challenge to these limitations, with the latest cases coming out of Minnesota and the 8th Circuit. I can send you the cites to those if you are interested.
