Default Yes On B Coalition To Ask County For Marijuana Legislation

Following voters' approval of the controversial Measure B in June, the main organization that supported the item is planning to try to further restrict the cultivation of marijuana in Mendocino County.

Measure B, which was approved with approximately 52 percent of the vote, set medical marijuana limits in the county at six mature or 12 immature plants and eight ounces of dried marijuana, the same guidelines used by the state.

"A representative of the Yes on B Coalition will read a statement to the Board of Supervisors this Tuesday, at approximately 10 a.m. asking for action to protect the public from harmful impacts of marijuana cultivation," stated a portion of a release issued by the group. "There may be an opportunity for additional audience comment."

According to the release, the statement, developed by the steering committee, proposes that the supervisors:

1. Amend the existing county nuisance ordinance to name off-site marijuana odors as a nuisance.

2. Amend the nuisance ordinance to name off-site visibility of marijuana plants as a nuisance.

3. Amend the nuisance ordinance to make violation of the ordinance a criminal offense, rather than merely a civil offense.

4. Adopt a new ordinance to prevent dispensing of diesel fuel into unsafe tanks.

5. Adopt a new ordinance establishing a Medical Marijuana Impact Fee to be paid by all medical marijuana growers, with proceeds going into a Medical Marijuana Impact Fund to be used to ensure compliance with nuisance rules.

"The work we began with Measure B is still incomplete, and will be incomplete until reasonable protections are available to all residents from the impacts of nearby marijuana growing," stated a portion of the release.
