Default Supco Sides With Man In Medical Marijuana Case

Supporters of the Montana Medical Marijuana Act are lauding a decision by the state Supreme Court in a case involving a Conrad man who pleaded no contest to criminal possession or manufacture of dangerous drugs.

The high court ruled Wednesday that District Judge Laurie McKinnon overstepped her authority with the sentencing conditions she placed on Timothy Nelson.

Nelson was charged in May 2006 after authorities searched his house and found evidence of a marijuana growing operation. He suffers from a degenerative disc disorder and was later accepted into Montana's medical marijuana program.

McKinnon gave Nelson a 3-year deferred sentence and ordered that he not possess marijuana, except in pill form.

Nelson argued on appeal that the sentencing condition ignored the intent of Montana's Medical Marijuana Act. The high court ruled 6-1 in his favor.
