Oh, to have been a fly on the wall Monday when L.A. City Atty. Carmen Trutanich and Dist. Atty. Steve Cooley got the dual bad news -- well, bad news for them at least -- about the U.S. Justice Department's memo regarding marijuana policy and the California Superior Court's injunction, which bans enforcement of the city's moratorium on cannabis dispensaries, issued that same day.
Employees of medical marijuana dispensaries in Los Angeles have been showing up for work daily for the last few weeks fearing imminent police raids and participating in "raid drill" workshops, but these nerve-wracking preparations were for naught in the wake of the court's injunction and Atty. Gen. Eric H. Holder Jr.'s statement when he released the new guidelines. “It will not be a priority to use federal resources to prosecute patients with serious illnesses or their caregivers who are complying with state laws on medical marijuana,” Holder said, effectively asking state law enforcement officials as well, to make cannabis-related arrests a low priority. In practical terms, with the moratorium now lifted in Los Angeles, practically anyone can open a medical marijuana dispensary. Some observers feel the city should brace for a surge of new dispensaries opening, while others feel that Los Angeles is already over-saturated with too many dispensaries and that a major increase in their number seems unlikely. In an article by the L.A. Times on the judge's ruling, this tiny, yet amusing, gem of information appeared: An undercover narcotics officer visited at least twice, according to a declaration Officer Brent Olsen filed with the court. On Sept. 2, he said he handed over his identification and doctor's recommendation and filled out a form. Buzzed into an interior room, he said he was told there were 60 strains available. He paid $58 for one-eighth of an ounce of marijuana. On Sept. 10, he paid $55 for another eighth. "It is my opinion that the dispensary is being used to sell marijuana," Olsen said in the declaration. Nice work, officer, very resourceful.
