The Brush City Council on Monday considered a moratorium on medicinal marijuana and the possible reorganization of some city staff.

During the special work session, Assistant City Administrator Karen Schminke said she met with each council member individually to discuss a draft proposal to regulate local marijuana dispensaries.

The proposal would require the owners of local dispensaries to obtain a business license, Schminke said, and some council members were interested in increasing the licensing fee for the particular type of business.

If the proposal were approved, the businesses could operate between 7 a.m. and 6 p.m. Monday through Saturday. They would not be allowed to conduct business on Sunday.

The proposal would not allow a marijuana dispensary to operate within 500 feet of a school, childcare center, alcohol or drug rehabilitation facility, correctional facility or another dispensary.

Though some of the council members may not want the dispensaries in Brush, she said, they seemed to agree that the proposal offered a reasonable way to regulate them.

“In my meetings with everybody, it sounds like everybody was really quite comfortable overall with the proposal,” she said.

However, most council members indicated that they did not want to adopt the proposal immediately because the Colorado Legislature is still debating the issue.

“If we do adopt an ordinance, we’re potentially looking at needing to do an amendment six months from now,” Schminke said.

Brush Attorney Robert Chapin recommended that the council impose a temporary moratorium on local marijuana dispensaries until the state legislature comes to a consensus. If the council were to adopt an ordinance immediately, he said, it may need to re-write the legislation in several months.

Brush Administrator Monty Torres asked Chapin to assemble a moratorium to prohibit local marijuana dispensaries until July 1. The council planned to vote on the item in a future meeting.
