The Butte-Silver Bow County attorney's office had dropped a marijuana production charge filed against a 52-year-old Butte man who was eligible for a medical marijuana card.
Mitchell Booth was charged last October, after authorities raided his home and found a dozen mature marijuana plants. In moving to dismiss the case, Deputy County Attorney Kelly Fivey says Booth could have used the Medical Marijuana Act as a defense against the charge, even though he was not a registered card holder. Booth has multiple sclerosis, which would have qualified him for a medical marijuana card.
