Default Relocation Request Would put Shasta Lake Marijuana Collective too Close to Park

SHASTA LAKE - A medical marijuana collective here is asking the Shasta Lake City Council for permission to move to a new location that would violate a city rule that prevents such businesses from being within 1,000 feet of a public park.

In a Jan. 20 letter to council members, Green Heart Collective owner Gina Munday says she is "stuck in (an) extremely large building" on Shasta Dam Boulevard and would like to move across the street and down about two blocks.

The matter is on the agenda for the council's Tuesday meeting.

Development Services Director Carla Thompson replied in a staff report that the proposed relocation would not meet the city's separation distance of at least 1,000 feet between a marijuana collective and a park. Munday's proposed location is about 835 feet away from Claire Engle Park, which also has a skateboard park, Thompson said.

Munday, who said in her letter that she's invested a lot of money and time in the Green Heart Collective & Garden Center, was not available for comment Saturday.

While Thompson said the city's staff would recommend denial of Munday's request, she did say that Munday could apply to the Planning Commission for a variance, which carries a total application fee of $1,690.

City Council members also could refer the request to the Planning Commission with instructions to review and consider modifying the separation-distance requirements, Thompson said.

Other options that Munday could pursue would be to keep the collective at its present location and move the garden center portion of the business to the new spot or to an appropriately zoned commercial district, Thompson said.

The staff report also lists several locations along Shasta Dam Boulevard where the collective would be allowed to relocate.
