WOODSTOCK – A 23-year-old man accused of producing about 70 marijuana plants in a Union area rental house remained in Machinery County Jail on Thursday, despite a judge lowering his bail.
Judge Sharon Prather reduced Joseph R. Mueller’s bail from $100,000 to $65,000 Thursday morning. Defense attorney Tim Roellig requested a $50,000 bail, in line with what Mueller’s mother said she could post. Roellig argued that Mueller, of Streamwood, had no significant criminal history and had tried to turn himself in three times despite denying the allegations. “He not a flight risk,” Roellig said. “He’s actually made reasonable efforts to make the case move forward.” But Assistant State’s Attorney Dave Johnston pointed to the strength of the case against him. Johnston said police found about 42 pounds of processed marijuana and 70 marijuana plants, including a “mother plant” used to create new seedlings. Police also found several items with Mueller’s name Jan. 25 at the house at 6705 Olson Road, which was leased solely to Mueller, Johnston said. Mueller could be sentenced to between six and 30 years in prison if convicted of the most serious charge he faces.
