Default Pacific Grove Injunction Prohibits Marijuana Dispensary Sales

CA - Sponsors of a medical marijuana dispensary named the Apothecary Inc. were served a notice of injunction by Pacific Grove City Attorney David Laredo on Wednesday, prohibiting any transfers or sales of marijuana on the property at 115 Central Ave.

The announcement of the injunction was made after the council broke from a closed-door session Wednesday to discuss litigation.

Laredo named Daniel Maniscalco, Tamara Mims, Erica Gamecho and Carmen Nazay specifically in the injunction, filed on grounds that the city has declared a moratorium on issuing permits for such dispensaries.

Maniscalco told the council that no marijuana transactions had taken place on the property.

Convening in open session, the council voted 6-1 to extend the moratorium for 10 months, but asked city staff to return with recommendations for regulating such dispensaries or banning them altogether in May.

In other action, the council voted 4-3 to instruct its staff to negotiate with Everyone's Harvest Inc. for a change in its use permit that would move Pacific Grove's downtown farmers market from Lighthouse Avenue to the parking lot between 16th and 17th streets, and change the day of operation from late Monday to early Saturday.

The council is expected to act on the change at its April 7 meeting.


Dissenting were Bennett, Councilman Bill Kampe and Councilwoman Deborah Lindsay, who took issue with an announced compromise presented to the council by Pacific Grove Chamber President Moe Ammar. The compromise on the move and day change was reached after a meeting of members of the downtown Business Improvement District and Everyone's Harvest.

Bennett, Kampe and Lindsay contended that the farmers market had been the object of extensive public hearings and that the change shouldn't be the result of a closed-door meeting.
