He sentenced Morse to 25 days in jail, but delayed the sentence and said he would reduce it to five days if Morse performed community service.

Morse defiantly told Franson he would not perform the service.

And he told the judge he would reopen his clinic.

Earlier, Franson had refused to allow Morse to call Fresno police chief Jerry Dyer, city councilman Henry T. Perea and interim city manager Bruce Rudd as witnesses.

Morse said they were part of a conspiracy to deny him his civil rights.

Morse and Franson engaged in an ongoing verbal duel during the courtroom proceedings, with Franson telling Morse at one point: "I know you think you run the courtroom, but I do."

At one point, Franson tossed Morse's son Brandon out for using a cellphone.
