Default A Joint Effort

FOUR foreign nationals were before Limerick District Court for cultivating cannabis plants in the garden of their rented house. Daniel Zwierzanski and Andrze Wadolkowski, both 31, and Sebastian Kozina, aged 34 and Vladimir Puchala, aged 24, all with an address in Landsdowne Gardens, Ennis Road, pleaded guilty to unlawful Possession of Cannabis and Cultivation of cannabis, contrary to Section 3 and 17 of the Misuse of Drugs Act.

Detective Garda Pat Crowley told the court that the defendant’s rented house was searched under warrant on September 13, 2006, and they were found in possession of a small amount of cannabis. "A further search revealed four cannabis plants growing outside, which the occupants admitted to tending. All four pleaded guilty,” he said.

Judge Timothy Lucey said "So each person had their own little plant. And they were all responsible for watering their plant?” Det Garda Crowley answered that the four took care of all of them, to which the Judge quipped "All for one and one for all”.

Solicitor John Devane then joked "It was a ‘joint’ effort Judge,” to the amusement of the courtroom.

The garda added that the defendants were cultivating these plants from pots in a garden shed.

Defence solicitor for the four defendants, Sarah Ryan, said that The cannabis found was for a mixture of their own use and for experimentation. She also stated that there was no gain in it for her clients and pointed out that one plant hadn’t even been growing particularly well.

"All four clients had co-operated fully with gardai. Three of them were in the house at the time of the search and the other one came afterwards to the garda station and admitted everything. None have previous convictions. They are three Polish and one Slovakian national. This activity has also been stopped,” she said.

Judge Lucey said that because they have pleaded guilty and have no previous convictions, he will apply the Probation Act.

"This is on the assurance that they stop growing cannabis and won’t be caught in possession of it again,” he said.
