Two young men who were caught in possession of cannabis while riding on a scooter in Belles have been fined.
Kenny Roberts 23, and Dian Luke, 24, were charged with possession and intent to supply cannabis, but the second charge was dropped against Roberts in Magistrates’ Court today. According to the facts of their cases, presented by the police prosecutor , the two men were stopped on a scooter by officers on a cruise patrol. They had first noticed Luke, the pillion driver, throw a yellow plastic bag into the bushes while riding on the bike. “Having stopped the area, the officer took the defendant back to that area where he had seen him throw the yellow bag and asked him what he had thrown away,” the prosecutor explained. “Weed that there,” Luke remarked. Constable Alexander, who had retrieved the bag and opened it in the presence of the defendant noticed a black plastic bag wrapped in grey tape. When cautioned, Luke said, “Officer I tell you is weed that in it.” The cannabis weighed 1384 grams – a total of four pounds with a street value of $4,000. Luke was fined $6,000 on the intent to supply charge and no separate penalty for the possession charge. One thousand dollars of that fine is expected to be paid by May 31, 2010 or he will face three months in jail. The balance was ordered to be paid by September 30, 2010 or he will face eight months in prison. Thirteen grams of cannabis was found on Roberts – the motorcycle driver. He told police that it Luke had just given him the cannabis. He was fined $600 to be paid by May 31 or he spends one month in prison.
